PROPERTY TRANSACTION TERMS AND CONDITIONS

 

1. Introduction

 

These Terms and Conditions ("Terms") govern the use of Aclopros's platform for property transactions, including buying, selling, renting, leasing, and other related activities. By using our platform, you agree to be bound by these Terms.

 

2. Definitions

 

"Buyer" means a person who purchases a property through our platform.

 

"Seeller" means a person who lists a property for sale or lease through our platform.

 

"Renter" or "Lessee" means a person who rents or leases a property through our platform.

 

"Lessor" means a person who lists a property for rent or lease through our platform.

 

"Property" means any real estate, immovable or movable property listed on our platform, including but not limited to:

 

•     Automotive

•     Residential properties

•     Commercial properties

•     Hotels

•     Lodges 

•     Gardens 

 

"Platform" means our website, mobile application, or other online platform.

 

3. Property Listings

 

3a. Sellers and Lessors are responsible for ensuring the accuracy and truthfulness of their property listings.

 

3b. Property listings must include complete and detailed information about the property, including but not limited to:

 

•     Property description

•     Location

•     Price

•     Features and amenities

•     Any defects or issues

 

3c. Sellers and Lessors grant us permission to display and distribute their property listings on our platform.

 

 

4. Buyer and Renter Responsibilities

 

4a. Buyers and Renters are responsible for conducting their own research and due diligence on any properties that interest them.

 

4b. Buyers and Renters should verify the accuracy of any information provided about the property, including but not limited to:

 

•     Property description

•     Location

•     Price

•     Features and amenities

 

4c. Buyers and Renters are responsible for complying with the terms and conditions of any purchase or rental agreement.

 

5. Payment Terms 

 

5a. Buyers and Renters agree to pay the purchase price or rent and any applicable fees or costs associated with the transaction.

 

5b. Payment terms will be outlined in the purchase or rental agreement.

 

6. Cancellation and Refund

 

6a. Buyers and Renters may be subject to penalties or fees if they cancel the purchase or rental agreement.

7. Liability

 

7a. Sellers, Buyers, Lessors, and Renters are responsible for any losses or damages caused by their breach of these Terms or any purchase or rental agreement.

 

7b. Parties agree to indemnify and hold harmless our company, its officers, directors, employees, and agents from any claims or liabilities arising from the transaction.

 

8. Dispute Resolution

 

8a. Any disputes arising from these Terms or any purchase or rental agreement will be resolved through arbitration in accordance with the laws of Zimbabwe.

 

8b. The arbitration will be conducted by a single arbitrator appointed by mutual agreement of the parties.

 

9. Data Collection and Protection 

 

9a. The Company collects personal data from Users, including but not limited to name, email address, phone number and property details.

 

9b. The Company uses this data to provide and improve the Services, and to communicate with Users.

 

9c. The Company takes reasonable measures to protect User data, including implementing security protocols and encrypting sensitive information.

 

10. Termination

 

10a. The agreement can be terminated in accordance with the terms outlined in the purchase or rental agreement.

 

 

11. Governing Law 

 

11a. These Terms are governed by and construed in accordance with the laws of Zimbabwe.

 

Additional Terms 

 

Sellers: Ensure that their property is in the condition described in the listing and disclose any known defects or issues.

 

Buyers: Inspect the property and identify any defects or issues.

 

Lessors: Ensure that their property is in the condition described in the listing and disclose any known defects or issues.

 

Renters/Lessees: Comply with the terms and conditions of the rental or lease agreement.

 

Hotel, Lodge, and Garden Owners: Ensure that their property listings accurately reflect the services and amenities provided.
